AN ORDINANCE BANNING THE DISPLAY OF
STREAMERS USING ELECTRICAL POSTS, ELECTRICAL LINES AND
TELECOMMUNICATION LINES AS CONNECTING FACILITIES IN THE
MUNICIPALITY OF GONZAGA, CAGAYAN
Be it ordained by the Sangguniang Bayan of
Gonzaga, Cagayan in session duly assembled; that
Section 1. Title.
This ordinance shall be known as “An
Ordinance Banning the display of streamers using electrical
posts, electrical lines and telecommunication lines as
connecting facilities in the Municipality of Gonzaga, Cagayan”
Section 2. Regulatory
Act.
a.
No person or group of persons,
representative of business entities or corporations is allowed
to display any form of streamers using electric posts,
electrical lines and telecommunication lines as connecting
facilities.
Section 3.
Definition of Terms: As used in this ordinance, the following
shall mean;
a.
Streamers-
any long narrow wavy strip containing advertisement/
announcement.
b.
Electrical posts-
a pole of wood, concrete or metal where wires and cables
attached, mounted/suspended
c. Electrical
lines – carrying or conveying
electricity in forms of wires and cables
d.
Telecommunication lines-
wires and cables. transmitting information electronically
e.
Connecting facility-
electrical post, electric and telecommunication lines
f.
Business entity-
a company or other organization that buys and sells goods, makes
product or provides services
Section 4. Penalty Clause.
Violators of this ordinance shall be penalized as follows:
a. For the 1st offense------
P 100.00 for each streamer hanged.
b. For the 2nd offense-----
P 500.00 for each streamer hanged.
c. For the 3rd offense &
succeeding offenses-P2000.00 for each streamer hanged
Section 5. Enforcement
of this Ordinance. Aside from the
Municipal Enforcement Team (MOET), all barangay officials,
barangay tanods or barangay police within the territorial
jurisdiction of the municipality of Gonzaga are hereby
authorized to enforce this ordinance.
Section 6. Distribution of Fines collected.
Fines collected in violation hereof will accrue to the General
Fund of the Municipal Government. In cases the apprehension is
made by the barangay officials or its barangay tanod or barangay
police, fifty percent (50%) of the fines collected shall accrue
to the General Fund of the barangay.
Section 7. EFFECTIVITY.
This Ordinance shall take effect immediately upon compliance of
the requisite publication and posting as expressly required by
law.
Section 8. REPEALING CLAUSE.
All Municipal Ordinances, Resolutions or Executive issuances
inconsistent herewith are hereby repealed accordingly.

ORDINANCE AMENDING ORDINANCE NO. 7, S. 2006, ENTITLED,
“EQUIPMENT RENTAL ORDINANCE 2006 OF THE MUNICIPALITY OF GONZAGA,
CAGAYAN
Section 1. Title.
This ordinance shall be known as “Equipment Rental Ordinance
2007 in the Municipality of Gonzaga, Cagayan”.
Section 2.
Equipments owned by the Municipal Government of Gonzaga,
Cagayan may be allowed to be rented by any interested persons,
Private entities and Other Government Agencies subject to
payment of rentals in accordance with the following rates which
shall be increased from time to time depending upon the
prevailing rate of the Association of Carriers and Equipment
Lessors (ACEL).

Section 3. RULES AND REGULATIONS
Equipments owned by the Municipal Government of
Gonzaga, Cagayan may be allowed to be rented by any interested
persons, Private entities and Other Government Agencies subject
to the following rules and regulations:
a.
The Lessee will shoulder all costs
on fuel and oil requirement of the equipment, bear the cost of
mobilization of the leased equipment to the jobsites and return
these to the municipal motor pool and will pay fifty (50%)
percent of the total cost before any equipment is dispatched.
The remaining balance will be paid after the job has been done.
b.
In the case of farm tractors, full
payment of the rental shall be paid before the farm tractor
shall be dispatched.
c.
The computation of rental shall be
8 hours per day including idle time and travel time with at
least 80% operation time for self moving equipment, like, dump
truck, grader, elf, farm tractor, and prime mover.
d.
That the equipment shall be
operated only by employed and authorized operator of the
Municipal Government of Gonzaga.
e.
That the lease contract shall be
executed between the Municipal Mayor (lessor) and the borrower
(lessee), 50% of the rental cost estimated for the duration of
the lease contract be paid to the Municipal Treasurer before the
equipment is dispatched. Balance shall be paid upon termination
of the lease contract.
f.
That the lease contract shall
commence when the equipment leaves the municipal motorpool and
terminate upon return of said equipment at the motorpool.
g.
The Municipal Government of
Gonzaga, Cagayan shall have the right to terminate the contract
upon written notice to the lessee for the following reasons:
1. If the lessor’s opinion, continued operation
will result in accelerated damage to the equipment and
accessories;
2. If the Lessee has violated any provisions of
the rental contract and due to non-payment of the rental fees,
however, the cost of returning the equipment and accessories to
the yard of the lessor shall be for account of the lessee. The
lessee shall bear the cost of mobilization of the leased
equipment to the jobsite and return thereof.
j. When the requesting party is barangay, a
farmer’s association, duly accredited organization or group by
the SB of Gonzaga, within the municipality the use of needed
equipment(s) shall be borrowed free of charge. PROVIDED, that
the requesting barangay, farmers association, duly accredited
organization or group, shall shoulder the expenses for fuel,
lubricants and per diem of the operator or driver.
k.
The administration, management and
monitoring of all leased municipal equipment shall be under the
following

Dump trucks, Pay Loader, Grader, Prime Mover,
Back Hoe, Elf, Dozer/Loader, Road Roller and concrete mixer
MUNICIPAL
AGRICULTURE OFFICE
Farm Tractor (Massey Ferguson, Power Tiller
Farm Tractor (kuliglig) and Maka Masa Farm Tractor.
GENERAL SERVICE OFFICE
Power Generating Sets (big and small)
l.
All income derived from the rental
shall be properly receipted and shall be disbursed in accordance
with existing Accounting and COA Rules and Regulations.
Section 4. Penalty Clause. Any
Municipal Official or employee found violating any
provision/rules and regulations of this ordinance
shall be subjected to penal provision under the anti-graft law
and other existing laws and as well as the Civil Service Rules
and Regulation for its administrative aspect.
Any lessee who violates or in any way connive
with official or employee purposely to take advantage any
provision of this ordinance shall be forever banned from
availing the services of LGU owned equipment.
Section 5. EFFECTIVITY.
This Ordinance shall take effect immediately upon compliance of
the requisite publication and posting as expressly required by
law.
Section 6. REPEALING CLAUSE.
All Municipal Ordinances, Resolutions or Executive issuances
inconsistent herewith are hereby repealed accordingly.

LOADING AND HAULING OF QUARRY RESOURCES
ORDINANCE IN THE MUNICIPALITY OF GONZAGA, CAGAYAN
Be it ordained by the Sangguniang Bayan of
Gonzaga, Cagayan in session duly assembled; that
Section 1. Title.
This ordinance shall be known as “Loading and Hauling of
Quarry Resources Ordinance in the municipality of Gonzaga,
Cagayan”.
Section 2.
Loading and Hauling Services of any quarry resources from
designated quarry sites of the municipality by equipment owned
by the Local Government Unit of Gonzaga, Cagayan may be availed
by private individuals on a pay per load basis as follows:
-
Loading fee per cubic meter
1. Mixed aggregates/back filing
P 54.00/cu.m.
2. S-1 - Fine Aggregates; Single Screened
gravel P 75.00/cu.m.
3. G-1 – Coarse Aggregate; Double Screened
gravel P 93.00/cu.m.
b. Hauling fee per cubic meter
1. Mixed aggregates/back filing -
P 160.00/cu.m. for the first 5 kilometers distance from quarry
source and an additional
P18.00 per cu.m. for each kilometer distance of travel.
2. S-1 (Fine aggregates)
P 200.00/cu.m for the first 5 kilometers distance from quarry
source and an additional P P18.00 per cu.m. for each
kilometer distance of travel.
3. G-1(Coarse aggregates)
P 250.00/cu.m. for the first 5 kilometers distance from quarry
source and an additional
P 18.00 per cu.m. for each kilometer distance of travel.
Section 3.
Rules and Regulations:
-
Loading and Hauling of quarry resources are
done only during Mondays to Fridays.
-
The Municipal Engineering Office shall
compute/asses the amount to be paid based on type of quarry
resources, volume and distance.
-
Prospective private haulers must first pay
the necessary fees to the office of the Municipal Treasurer
based from the assessment of the Municipal Engineering
Office.
-
No hauling services of any equipment owned by
the Municipal Government Unit of Gonzaga shall be made
unless buyers pay the necessary fees provided for in this
ordinance.
-
No loading and hauling of any quarry
resources shall be made without presenting the Official
receipt issued by the Municipal Treasurer to the designated
checker or the operators of the heavy equipments.
Section 4.
Penalty Clause. Any Municipal Official or employee found
violating any provisions of this ordinance shall be subjected to
penal provision under the anti-graft law and other existing laws
and as well as the Civil Service Rules and Regulation for its
administrative aspect.
Any lessee who violates or in any way connives
with any official or employees for the purpose of taking
advantage of any provision of this ordinance shall be penalized
as follows:
1.

Section 5.
